Contract
All parties involved will require a written, signed and faxed copy of details including but not limited to the following: Details regarding any services including website design, CD design, flyers, navigation, textures, fonts, photos not/and or provided, includes html and other programming. Client will receive this outline of work to be included as well as use, copyright, services and payment.

Services Available
Website design including but not limited to: Photo manipulation, stock photography, fonts, textures, navigation, photos not/and or provided, flyers, banners, wallpapers, buddy icons, mp3s, video editing and or alternate video formats. Customized Myspace layout and coding.

Programming: Software used for self updating (i.e. Journal and or news). Word Press, Greymatter, commenting system enabled or disabled. Also includes customization and implementation of Word Press or Greymatter into layout/design. Programming is limited to hosting companies not providing CGI or PHP support. Also available is a Coppermine photo gallery, guestbook, mailing list, XMB or other forum customization also available.

CD Design: Includes but not limited to Cover, clear tray, back, inside panels etc. Photos and information need to be provided by client.

Service Agreement
During the duration of the agreement, credit and contact information is to remain visible at all times until design, layout and content created by the designer are no longer in use. Such removal of credit will result in termination of contract, service agreement which can result in removal of files court proceedings and/or acceleration of payment. Entire Contracts will have no oral agreements between parties. Contracts will contain the entire agreement between parties and may not be changed except by written agreement. Should a court find any clause in a contract unenforceable, the remainder of the contract will not be affected and all other provisions in the contract will remain enforceable. The laws of the State of California govern the interpretation, validity, performance and enforcement of all contracts. CD Design requires designer credit placed somewhere on inside panel. Client will receive thumbnails and frequent updates on design progress and ideas. I will work with you to create the design, overall look/feel you are looking for.

Copyright
By agreeing to this you understand the Copyright Act; any images used i.e. from search engines or other works of art that were/were not given credit including fonts, brushes, textures, photos, and any content included in website that the designer will not be held responsible for copyright infringements filed, claimed or perused in court.

Use
By agreeing to this you understand Non-Exclusive use. Any designs created can be included in a personal portfolio and certain items such as look/feel i.e. “grunge, flower, vintage,” or other themes can and possibly be used for other clients. However client has the right to use design(s) in the following: flyers, banners, wallpapers or any other items of choosing as long as original creator is given credit. The use covers the design to be exclusively used for the client only, which only covers exact duplication and overall “look, feel, or theme,” such as “grunge or floral” cannot be covered and can also be used for other clients requesting similar “colors, brushes, or theme.”

Updating the website
Updates will occur for a six month period that includes all pages including content. Additional major layout changes will require additional fee. For a full year of updating $100.00 is required in upkeep (about $8 a month), only including update of all pages therein including content, i.e. images, audio, links, news etc. Also includes slight layout modifications not site overhaul or redesign. Six months or one year starts after completion of layout, pages and content.

Payment
Payment rate is mutually agreed upon by all parities; initial starting fee, interim and final fee are required. The final fee for design, use and updating of the website is to be full in paid 7 to 10 business days (unless other payment arrangements have been made) after completion (payment failure will result in termination of contract and service agreement). The total fee does not include a year of updating but rather a total of six months, if client chooses to have all updates occur during one year, the agreement must be made with additional contract payment alterations. Please understand additional fee is required for one year as there is other cliental and business. Also please note payment negotiability is acceptable based on rate of pay or overall total price. Payments accepted are check, Paypal or wired transfer; both parities will receive proof of payment.
